Program License Agreement

Downloading any software from our Web site or opening the seal on the diskette package constitutes your acceptance of all of the terms and conditions stated in this agreement. If you do not agree with any of the terms and conditions, promptly return this unopened package and all other materials to the place of purchase for a full refund.

License. The SPF* software program and its accompanying documentation (the "Software") is owned by Command Technology Corporation ("CTC") and is licensed to you for use under the following conditions.

Under this license you MAY:

  • Use one copy of the Software on any single computer (including any single terminal) provided a license fee has been paid and you use the Software on only one computer at a time.
  • Use the Software on a single network server provided the number of concurrent users on the network at any time does not exceed the number of licensed copies of this Software.
  • Make one copy of the Software for backup or archival purposes, or copy the Software onto the hard disk of your computer and retain the original for backup or archival purposes.
  • Permanently transfer the license to another party IF you transfer your original diskette AND all copies of the Software, and the recipient agrees to be bound by the terms of this license.

You MAY NOT:

  • Copy the Software except as specifically provided above, loan, rent, or otherwise transfer the Software to others, reverse engineer, de-compile, disassemble or create derivative works from the Software, or take any action inconsistent with CTC's ownership of the Software. Any violation of these provisions will automatically revoke this license and will subject you to legal liability.

LIMITED WARRANTY. SOFTWARE IS INHERENTLY COMPLEX AND MAY NOT BE ERROR-FREE. THE SOFTWARE IS NOT WARRANTED AND IS PROVIDED "AS IS". HOWEVER, CTC WARRANTS THAT THE ENCLOSED DISKETTE ITSELF IS FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP UNDER NORMAL USE FOR 90 DAYS FROM THE DATE OF PURCHASE. CTC WILL REPLACE A DEFECTIVE DISKETTE AT NO CHARGE UPON RETURN OF THE DISKETTE TO CTC ALONG WITH PROOF OF PURCHASE. THIS IS YOUR SOLE REMEDY UNDER THIS LICENSE.

THE ABOVE WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

LIMITED LIABILITY. CTC WILL NOT BE LIABLE IN A CONTRACT OR TORT ACTION FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, AND BUSINESS INTERRUPTION, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

U.S. GOVERNMENT RESTRICTED RIGHTS. The enclosed program and documentation are provided with RESTRICTED AND LIMITED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions as set forth in FAR Sec. 52.227-14, Alternate III(g)(3), FAR Sec. 52.227-19 or DFARS Sec. 52.227-7013(c)(1)(ii), as applicable. Miscellaneous. This is the entire agreement concerning the license and use of Command Technology products and supersedes all prior statements or agreements on the subject.
